Solution:
Upstairs Mitsubishi Electric Multi Head System 5.4kW. Outdoor unit to rear wall on wall bracket of first floor. Supply a 2.5kW head unit in the master room and 2.2kW head in bedroom 2 and bedroom 3. Installation, Product and Service Terms and Conditions

PRODUCTS AND INSTALLATION

  1. Rapid Cold shall not be bound by any quotation if an order is placed later than 14 days from the date of quote.
  2. If Rapid Cold deems that the circumstances have materially changed from any prior quotations, revision will be required.
  3. All prices are inclusive of GST.
  4. A deposit, minimum of 50% or as specified in written quotation, must be paid before confirmation of works and ordering of stock. Payment must be made without deduction, retention or set-off of any kind. Rapid Cold reserves the right to delay installation until specified payments are cleared.
  5. Completion or Progress Payments are due before final installation is complete.
  6. If prior approval is given by Rapid Cold to make payment after completion of works, full payment must be given at such time.
  7. The Customer is responsible for making final payment on the day of completion. Failure to complete payment will result in interest charges of 1% per day, where payment is not made for more than 5 business days.
  8. Variation of any order, dealing or arrangement must be agreed in writing. The Customer must agree to any changes in charges under a signed copy of our Variations Form before works can continue.
  9. Cancellation of any order, dealing or arrangement must be agreed in writing. A minimum notice period of 48 hours before commencement of installation must be given. A cancellation and restocking fee will be withheld by Rapid Cold equivalent to 15% of the invoice value.
  10. The Customer is responsible for keeping the site at which the goods and services will be delivered/performed, secure, safe (for the provision of the services by Rapid Cold and its personnel) and free from contamination. Any damage to, or loss from the site of, goods due to theft, vandalism or otherwise, or injury to Rapid Cold personnel, resulting from a failure in whole or in part by the Customer to keep the site safe and secure, will be at the risk and cost of the Customer.
  11. If the Customer is not at home at the time of installation, Rapid Cold will install the unit and relevant components such as, but not limited to, head units, condensers, outlets, controllers and return air, at a location determined by Rapid Cold. The Customer must pay Rapid Cold’s costs and expenses for any change of location of installed components done at the Customer’s request after installation.
  12. The Customer acknowledges and agrees that limiting structural factors may lead to Rapid Cold deviating from any planned installation location. The Customer agrees to not withhold any payments due to a change in the scope of work deemed by structural factors of their home or business.
  13. The Customer is responsible for the costs of returning any affected surfaces to their original condition, such as, but not limited to rendering, painting and plastering.
  14. In the course of Rapid Cold delivering the services and goods, the site may suffer minor contamination from such things including, but not limited to, nails, wood shavings, dust etc. While Rapid Cold will endeavour to clear the site of refuse caused by it, Rapid Cold will not be liable to the Customer in any way for such refuse or materials left behind.
  15. If the Customer is aware of any hazardous materials, including but not limited to, asbestos, in or around the site it is the responsibility of the Customer to provide Rapid Cold warning in writing before works commence. If hazardous materials are found by Rapid Cold personnel, we hold the right to discontinue works at any time.

  17. The Customer is responsible (at its sole cost) for (unless specified by Sales Consultant and/or in Scope of Work and inclusive of total charge):
    • All gas points for ducted heaters (including gas cocks) being provided and installed prior to fit off.
    • Roof access lights and power points for both heaters being provided and installed prior to fit off.
    • Appropriately sized electrical supply isolator being provided at an outdoor location, (and indoor on 3 phase units). It is the Customer’s responsibility to contact the manufacturer for appropriate amperage ratings.
    • Installation of gas and water isolator cocks prior to requested fit off for gas ducted heaters.
    • All required upgrades to the property’s electrical mains and switch boards.
    • Safe access being provided at the place(s) where the works are to be performed (to Rapid Cold’s satisfaction). This includes (but is not limited to) fall protection, scaffolding and safety guard rails on all double story and roof top installations.
    • Any actions taken after installation at the Customers request regarding the removal or clean up of hazardous materials, including but not limited to, asbestos.
    • Installation of (i) appropriate concrete support base or roof platforms for all outdoor units (condensers) making sure condensate is emitted from internal head units and external units. (ii) Rapid Cold will only drain to drainage points provided by others, i.e. tun dishes. (iii) Boxing and framing of all ductwork where required, bulkheads return and supply air grills etc. (iv) All penetration and coring for ducting and refrigeration piping, structural changes, and all builders work including control wiring and interfacing.
    • Installation and supply of access panels for unit, filter and branch box servicing. If access cannot be provided in appropriate location for servicing, plaster may need to be cut and replaced at Customer’s expense. Also, the manufacturer may refuse warranty under its access terms and conditions for warranty.
    • Modification of any structural beams, roof trusses, stud etc. to allow structural support and access to the quoted equipment.
  18. With ducted heating or cooling systems, Rapid Cold attempts to balance the outlets as best as possible, however precise balancing of air volumes is not possible, due to structural reasons, particularly to existing homes. If the Customer requests Rapid Cold to rebalance air volumes after the day of installation, this will be charged at Rapid Cold’s then current rates plus materials.
  19. The Customer agrees that Rapid Cold is not the manufacturer of any goods and Rapid Cold shall not be liable to any party as a manufacturer.
  20. Rapid Cold is an installation company only and the job is considered complete at the time the installation process is finished. This is irrespective of whether the goods are fully functional or in need of servicing under the manufacturer’s warranty, and the Customer agrees not to withhold any payment if servicing is required under the warranty agreement.
  21. Rapid Cold may subcontract all or any part of the provision of goods and/or services.
  22. Goods are sold subject to any manufacturer’s trading terms and conditions and are covered (if at all) by any manufacturer’s warranty applicable thereto. All warranty claims for ‘goods only’ purchases are to be made by the Customer directly to the manufacturer.
  23. Where zoning is quoted as part of a ducted system, it is taken that the system does not have capacity to heat and/or cool the Customer’s entire premises, and zones must be closed to heat and/or cool to achieve rated conditions.
  24. Property in goods will not pass, on any basis, until payment of all monies owed to Rapid Cold is first paid.
  25. Rapid Cold reserves the right to take possession and dispose of goods as it sees fit at any time until full payment is made.
  26. Immediately upon delivery the Customer accepts liability for the good/s.
  27. The Customer must limit any claim upon Rapid Cold relating to goods, to the cost of replacement of goods or the supply of equivalent goods and relating to services, to the cost of having services supplied again.
  28. Rapid Cold will not be liable for any claim arising after 7 days from delivery of goods only or performance of services (or at all once goods have been unpacked, modified, on-sold or otherwise used or applied) after which there will be deemed to be unqualified acceptance.
  29. Rapid Cold will not be liable in any way for any consequential, indirect damage arising from Rapid Cold Airconditioning Supply and goods, services to the customer, unless such damage arise, as a direct result of Rapid Cold Airconditioning negligent and recklessness.
  30. If the good supplied by Rapid Cold Airconditioning is faulty, any refund, repair or replacement of the faulty good will be subject to the assessment of the fault by the manufacture. And the manufacture’s determination as to whether a refund, repair or replacement is the appropriate cause of action.
  31. If Rapid Cold elects to take back a product, it must be in as new and saleable condition, and upon terms agreed, a re-stocking fee of no less than 15% of the invoice value will be applied. Custom-made or custom processed goods or goods acquired by Rapid Cold specifically for the Customer will not be returnable. Any goods which are accepted by Rapid Cold as defective may be returned and will be replaced free of charge or be the subject of a credit for the invoiced value. “Free of charge” does not include labour, transport or material costs.
  32. Rapid Cold disclaims any responsibility or liability whatsoever relating to suitability for any particular purpose or process. The Customer agrees to check all goods prior to use alteration or any application thereof whether in relation to suitability for any particular purpose, process or otherwise.
  33. The Customer indemnifies Rapid Cold against any claim or loss arising from or related in any way to any contract or dealing between Rapid Cold and the Customer or anything arising there from or arising as a result of or subsequent to any breach of these Terms.
  34. The Customer will pay all costs and expenses of Rapid Cold, its legal advisers, mercantile agents and others acting on its behalf in respect of anything instituted or being considered as a result of any breach of these Terms or breach of any dealings with Rapid Cold. Any costs associated with recovery of outstanding payments shall be passed on to the Customer.

SERVICE AND REPAIRS

  1. Service Call-Out Fee:
    1. The customer acknowledges that Rapid Cold charges a service call-out fee for dispatching a technician to diagnose and assess issues related to air conditioning units.
    2. The service call-out fee is non-refundable and is payable by the customer regardless of the outcome of the diagnosis or the subsequent repairs performed.
  2. 2. Field of Diagnostics:
    1. Rapid Cold recognizes that the field of diagnostics can vary based on the experience and approach of individual technicians.
    2. The customer acknowledges that diagnosing complex technical issues, such as those related to air conditioning units, can be challenging and may require extensive evaluation.
    3. Rapid Cold cannot guarantee an accurate diagnosis in every instance due to the inherent complexity of air conditioning systems and the limitations of available information at the time of diagnosis.
  3. Technician’s Assessment:
    1. Rapid Cold’s service engineer conducts the diagnosis and assessment based on the information available at the time of the service call-out.
    2. The customer understands that the assessment is made to the best of the service engineer’s knowledge and abilities.
    3. In the event of an incorrect assessment or diagnosis, Rapid Cold will not be held responsible for any additional costs or damages incurred by the customer, including but not limited to subsequent repairs or replacement parts.
  4. Customer Responsibility:
    1. The customer acknowledges their responsibility to provide accurate and complete information regarding the air conditioning unit’s symptoms and any relevant history that may assist the technician in the diagnosis.
    2. The customer agrees to cooperate with the technician during the diagnosis process and provide necessary access to the air conditioning unit and relevant components.
  5. Dispute Resolution:
    1. In the event of a dispute regarding the diagnosis or assessment, the customer and Rapid Cold agree to engage in good faith discussions to resolve the issue.
    2. Any disputes that cannot be resolved amicably shall be subject to the applicable laws and jurisdiction governing the location of Rapid Cold’s operations.

By engaging Rapid Cold’s services and paying the service call-out fee, the customer acknowledges and agrees to these terms and conditions.

NON WARRANTY SITUATION

Rapid Cold Airconditioning is committed to providing timely assistance for any issues related to heating and cooling systems installed by our company. We will allocate a technician to inspect and resolve the problem within 4 business days.

Non-Warranty Situations:

The following circumstances are not considered warranty situations unless otherwise authorized by Rapid Cold Airconditioning management:

  • Power point not working or not switched on.
  • Explanation of appliance operating procedures, including features and benefits.
  • General lack of user maintenance, such as blocked filters.
  • User error.
  • Damage, problems, or failure resulting from improper operation or inadequate maintenance, including dirty return air grilles/filters or soiled filters in split systems.
  • Acts of God, including fire, wind, lightning, flood, storm, earthquake, vermin, insects, spiders, or any other foreign objects or matter entering the product, such as dirt, debris, soot, or moisture.
  • Damage or failure caused by weather conditions, including but not limited to hail, salt, or other corrosive substances.

Service Call-Out Fee:

  1. If the issue is determined to be unrelated to installation or product faults, Rapid Cold Airconditioning reserves the right to charge a service call-out fee of $249 to customers.
  2. The service call-out fee is applicable to non-warranty situations as outlined above and is payable by the customer.

Authorization:

  1. Any warranty exceptions must be authorized by Rapid Cold Airconditioning management for the service call-out fee to be waived.
  2. The decision of Rapid Cold Airconditioning management regarding warranty exceptions is final.

By engaging Rapid Cold Airconditioning’s services, the customer acknowledges and agrees to these terms and conditions, including the possibility of a service call-out fee in non-warranty situations.
